It's not unheard of for people to put references or cameos into comic books without checking with the celebratory or proper IP holder.  Usually it's not that big of a deal, as they're just background images included by artists who truly love that stuff (or that celebratory) and are meant more as a reference then trying to actually make any kind of money off of somebody's name or IP.  However, GW goes after people who use their IP like a Tyranid Hive-Fleet goes after a Genestealer-infested Hive-World.  In the end, it's just about as pretty... especially since the Imperium of Disney is behind Marvel, now.

And as I have heard, they made generous donation already and the case is pretty much closed at this point, but it's an interesting thing nontheless.

Hmm, standard Corporate Arbitration. Yeah, especially as Eldar and Tau tend to be my favorite factions in 40k. And I've always preferred Marvel over DC (though I do enjoy both).

Also, I horribly misspelled celebrity a few times. Stupid auto-correct.

After giving it a few more thoughts, I've come to the conclusion that I'm just a little bit skeptical about the turret-less Falcon as being (intentional or direct) infringement. Mostly because it's a simple enough design that I wouldn't be surprised if somebody else did stumble across it by accident. But the Devilfish is clearly ripped off.

Hard to say. I bet GW would try to get proper compensation anyway now that they looked for it.
